Privacy Policy
What we collect when you shop or browse, what we do with it, who sees it, and how to change your mind. Short version first, the full policy below.
We collect what we need to take your order, ship it, answer your questions and, if you opt in, send you email or texts. Payments are handled by Shopify and the payment providers; we never see or store your full card number. We share data only with the services that run the store, and we do not sell it. You can unsubscribe, opt out of tracking cookies, and ask us to show, fix or delete what we hold. This summary is a convenience; the numbered sections are the policy.
1Information we collect
Information you give us. When you place an order, create an account, contact us, enter a promotion or sign up for email or texts, we collect what you provide: name, shipping and billing address, email address, phone number, order details, sizing or fit details you choose to share, and the content of your messages. Payment card details are entered into Shopify's checkout or the payment provider's page and are not received or stored by HauteFlair; we see only the card type, the last four digits and the authorization result.
Information collected automatically. When you browse the site, we and our service providers receive your IP address, device and browser type, operating system, the pages you view, the products you look at or add to your cart, referring pages and time zone. This is collected through cookies, pixels and similar technologies described in Section 4.
Information from others. Shipping carriers send us delivery status. Payment and pay-later providers send us the approval or decline result of a transaction, not your financial details. If you use Shop Pay, PayPal or a social sign-in, that provider shares the information you have authorized it to share.
2How we use it
- To fill your order: process payment, pack and ship, send confirmation and tracking emails, handle returns and exchanges.
- To help you: answer sizing questions, resolve order issues, and keep a record of past orders in your account.
- To run and improve the store: understand which products and pages are used, fix errors, test changes, and keep the site secure.
- To prevent fraud: screen orders for signs of fraud or abuse, which may include checking the billing address against the card issuer's records.
- To market to you, with your permission: send emails or texts about new arrivals, restocks, sales and fit advice. You can stop these at any time (Section 5).
- To meet legal obligations: tax records, responding to lawful requests, and enforcing our Terms of Service.
When you give us information to complete a purchase, arrange delivery or make a return, we treat that as consent to use it for that purpose. When we ask for information for another reason, such as marketing, we ask for your consent directly or give you a clear way to say no.
3Who we share it with
We do not sell your personal information, and we do not share it with third parties for their own marketing. We share it with service providers who need it to do their part of your order, and only to the extent needed:
| Who | What they do | What they receive |
|---|---|---|
| Shopify Inc. | Hosts the store, cart, checkout and customer accounts; stores order data on secure servers | Everything needed to run the store and process your order. See Shopify's privacy policy |
| Payment providers | Shopify Payments, PayPal, Shop Pay Installments (Affirm), Afterpay, Sezzle | Your payment details and, for pay-later plans, the information the provider needs to make its own credit decision under its own privacy policy |
| Shipping carriers | Deliver your order and provide tracking | Name, address, phone and email for delivery notifications |
| Returns portal provider | Runs the returns and exchange portal and prints labels | Order number, email, items returned and shipping address |
| Email and SMS platform | Sends order emails and, if you opted in, marketing email and texts | Email address, phone number, order history and browsing activity used to personalize messages |
| Analytics and advertising | Measure site use and show our ads on other platforms | Pseudonymous device and browsing data via cookies and pixels (Section 4) |
| Support and fraud tools | Help desk software and order-screening services | Your messages, order details and the signals used to screen an order |
We may also disclose personal information if required by law, subpoena or court order, to protect our rights or the safety of any person, to enforce our terms, or if HauteFlair is acquired or merged, in which case your information transfers to the new owner so they can continue to serve you. Some providers are located outside the United States; when your data is processed there it is subject to that jurisdiction's laws.
4Cookies and tracking
Cookies are small files placed on your device. We use them to keep your cart and session working, to remember your preferences, to measure how the site is used, and, where you allow it, to show you relevant ads elsewhere. Cookies set by Shopify's platform include:
| Cookie | Purpose | Duration |
|---|---|---|
| _secure_session_id, _session_id | Keeps your session and checkout working | Session |
| cart, cart_sig, cart_ts | Remembers what is in your cart | 2 weeks |
| _shopify_y, _shopify_s | Shopify analytics: distinguishes visits and sessions | 1 year / 30 minutes |
| _shopify_visit, _shopify_uniq | Counts visits for store statistics | 30 minutes / next day |
| localization, _tracking_consent | Remembers your country, currency and your cookie choices | 1 year |
| storefront_digest | Password-protected store access, when in use | Indefinite |
Third-party cookies and pixels may also be set by our analytics, advertising and email providers. You can block or delete cookies in your browser settings, though the cart and checkout need session cookies to work. Where a cookie banner is shown, you can decline non-essential cookies there and change your choice later from the link in the site footer. We do not currently respond to browser "Do Not Track" signals; we do honor Global Privacy Control signals where required by law.
5Marketing choices
Email. We send marketing email only if you signed up or opted in at checkout. Every marketing email has an unsubscribe link, and unsubscribing takes effect immediately for marketing; you will still receive order and shipping emails for purchases you make.
Text messages. We send texts only with your express consent, given at checkout or on a sign-up form. Message frequency varies; message and data rates may apply. Reply STOP to any text to opt out and HELP for help. Consent to texts is not a condition of purchase.
Advertising. To opt out of interest-based ads across websites, use your browser's cookie settings, the opt-out tools at optout.aboutads.info, or the ad settings in your Google, Meta or other platform accounts.
6Your privacy rights
Depending on where you live, you may have the right to know what personal information we hold about you, to receive a copy, to correct it, to delete it, to opt out of targeted advertising, and not to be discriminated against for exercising these rights. Residents of California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with consumer privacy laws, and residents of the EU, UK and Canada, have specific rights under those laws.
To make a request, email help@hauteflair.com with the subject "Privacy request", or write to the address in Section 10. We will verify your identity by matching details to your order history before acting. We respond within the time the applicable law allows, usually within 30 days. You may authorize an agent to make a request for you; we will ask for proof of that authorization. If we decline a request, we will explain why, and you may appeal by replying to our response.
California residents: we do not sell personal information, and we do not share it for cross-context behavioral advertising except through the advertising cookies described in Section 4, which you can opt out of there. We have not sold or shared the personal information of anyone under 16.
7Security and payment data
We take reasonable technical and organizational measures to protect personal information from loss, misuse, unauthorized access, disclosure or alteration. The site is served over TLS (the padlock in your browser), and access to order data is limited to staff who need it.
Payments are processed by Shopify Payments and the payment providers named in Section 3, all of which are certified to the Payment Card Industry Data Security Standard (PCI-DSS). Card details are encrypted in transit and stored by the provider, not by HauteFlair. No method of transmission or storage is completely secure; if we learn of a breach affecting your data we will notify you as required by law.
8Data retention
We keep order records for as long as needed to fulfill the order, handle returns and meet tax and accounting obligations, generally seven years. Account information is kept until you ask us to delete the account. Marketing consent is kept until you withdraw it, plus a record of the withdrawal so we honor it. Browsing and analytics data is kept in aggregated or pseudonymous form. When data is no longer needed it is deleted or anonymized.
9Children, international visitors, changes
Children. The site is intended for adults. We do not knowingly collect personal information from anyone under 18. By using the site you represent that you are at least the age of majority in your state or province, or are using it with the consent of a parent or guardian who is. If you believe a minor has provided us information, contact us and we will delete it.
Visitors outside the United States. HauteFlair is based in Georgia, USA, and your information is processed in the United States and in the countries where our service providers operate. By using the site you understand that your information is transferred to and processed in these locations, which may have different data protection laws from your own.
Changes to this policy. We may update this policy to reflect changes in our practices or the law. The current version, with its effective date, is always posted at this address. Material changes will be flagged on this page or by email if we have your address.
